1§ – General provisions

1.1. These Regulations set out the terms and conditions for the reservation and short-term rental services of the premises available at Villa Coaster. As part of the short-term apartment rental service, Villa Coaster agrees to provide the Client with an apartment, and the Client agrees to pay the remuneration and comply with the rules set forth in these Regulations.

1.2. Before making a reservation, the customer is required to read the Terms and Conditions. Making a reservation is tantamount to accepting its contents.

1.3. Villa Coaster declares that it holds the legal title to the Apartment, which is the subject of the agreement concluded with the Client, and is authorized to provide the service of temporary provision of the Apartment for tourist or leisure purposes.

1.4. Villa Coaster informs clients that pursuant to Art. 38(12) of the Law of May 30, 2014. on consumer rights, in the case of a contract for the provision of accommodation services other than for residential purposes, the consumer is not entitled to withdraw from the contract concluded at a distance or off-premises, which the Customer hereby acknowledges.

2§ – Definitions

2.1.
Apartment
– a dwelling, offered by Villa Coaster, described in detail on www.villacoaster.pl or other intermediary portals, which is the subject of booking;

2.2.
Villa Coaster
– Villa Coaster Grzegorz Urbańczyk;

2.3.
Client
– a guest, a natural person (18 years of age or older) or a legal entity, who is a party to a short-term apartment rental agreement or who expresses a desire to use the services of Villa Coaster by making a reservation for a selected apartment;

2.4.
Regulations
– These Rules and Regulations for short-term rentals;

2.5.
Resident
– a person designated by Villa Coaster, authorized to issue and collect the Apartment from the Client, as well as to perform other activities specified in these Regulations;

2.6.
Internet Service
– the website www.villacoaster.pl or any other website through which the possibility of making a Reservation is made available;

2.7. Booking – the action consisting in the selection of the Apartment and the date of stay in the Apartment by the Client and possibly other terms and conditions of such stay, performed through the Internet Service or by telephone, through which an agreement is concluded between Villa Coaster and the Client for the rental of the Premises in accordance with the offer and under the terms and conditions specified in the Regulations.

3§ – Reservation

3.1. Making a reservation is tantamount to accepting the content of the Terms and Conditions.

3.2. Reservation of the Apartment can be made as follows:

  • via www.villacoaster.pl;
  • via telephone at: +48 661 598 733
  • via an intermediary portal cooperating with Villa Coaster.

3.3. During the reservation, the customer is required to provide the following information:

  • The date of stay (date of check-in and check-out),
  • selected Apartment,
  • contact information (name, surname, telephone number, address, e-mail address),
  • the number of persons in the Apartment, with the proviso that it may not exceed the permissible number of persons indicated in the bid,
  • scheduled arrival time,
  • additional services.

3.4 Confirmation of the Reservation by Villa Coaster is made by delivering to the e-mail address provided by the Client during the reservation process a message with information about the confirmation of acceptance of the reservation, summary of the offer and determination of the total price of the service.

4§ – Reservation fee

4.1. A customer making a reservation through the Website is required to pay the total price of the service as indicated in the booking summary, following the instructions in the booking panel.

4.2. In the case of a telephone reservation, in order to confirm it, the customer is required to immediately pay the reservation fee by bank transfer to the account indicated in the confirmation of the reservation (in the amount of at least 30% of the value of the price of the service). Failure to post the above payment by hrs. 15:00 the following day entitles Villa Coaster to cancel the reservation. The balance of the service fee must be paid no later than 7 days before the agreed start date of the apartment. In the case of a telephone reservation, if there are less than 7 days left until the start date of the stay, the client must pay the full value of the reservation at the time of making the reservation, indicating the name of the apartment, the date of the stay and the reservation number in the title of the payment. The account number to which the transfer should be made is: 10 1050 1302 1000 0097 8236 7842, and the recipient is Villa Coaster Grzegorz Urbańczyk.

4.3. All payments between the Client and Villa Coaster are made non-cash and directly to the Villa Coaster Grzegorz Urbańczyk bank account 10 1050 1302 1000 0097 8236 7842

5§ – Change/Cancellation of Reservations.

5.1. Rebooking is possible only if the apartment has not yet been booked on the new date selected by the customer. If the price of the service on the new date is higher than the previous one, the customer is obliged to cover the difference in the price of the service. If the price of the service on the new date is lower than the previous one, Villa Coaster will refund the difference in the price of the service to the client within 14 days. Reservation changes are possible up to 7 days before the scheduled start date of the apartment.

5.2. Cancellation of the reservation by the client is possible up to 7 days before the scheduled start day of the stay in the apartment. In this case, the reservation fee paid by the customer, less the fee charged by the payment operator (about 1.5% of the value of the payment), is refunded within 7 working days to the bank account number indicated. In case of cancellation after the indicated date, the reservation fee will not be refunded.

5.3. The reservation may be canceled by the customer for reasons beyond his control, such as an emergency in the apartment, an error in the reservation system or withdrawal of the apartment from the offer. In this case, the client will be offered an apartment of comparable standard or the possibility to cancel the reservation free of charge.

5.4. In the event of the occurrence of unforeseeable circumstances in the apartment booked by the Client, the consequences of which cannot be remedied, Villa Coaster may offer the Client a substitute apartment of similar standard. The customer has the right to withdraw from the reservation with the obligation to refund all payments made to the designated bank account.

6§ – Check-in and check-out

6.1. The hotel day starts at 16:00 on the day of the beginning of the stay (check-in) and ends at 10:00 on the day of the end of the stay (check-out), according to the reservation.

6.2. Check-in is self-service based on instructions sent on the day of arrival to the phone number provided at the time of booking.

6.3. On the day of check-out, the customer is required to leave the keys to the apartment and any remote controls and parking cards (if issued) according to the instructions sent on the day of check-in. Failure to comply with this rule may result in the Client being charged for the costs incurred by Villa Coaster.

6.4. Villa Coaster reserves the right to charge a deposit of PLN 500 as security for the stay. The deposit is refunded in full on the day of departure, as long as no damage has been done to the apartment. The amount of the deposit may vary depending on the nature of the stay and the number of people. Deductions from the deposit do not exclude the possibility of claiming damages and lost potential income, the value of which exceeds the collected deposit.

6.5. Refusal to release the Apartment and cancellation of the Reservation:
Villa Coaster reserves the right to refuse the Apartment and cancel the Reservation for persons under the influence of alcohol, intoxicants, behaving aggressively and posing an immediate threat to other persons and property. Villa Coaster may also refuse to release the Apartment to Customers who have blatantly violated the Terms and Conditions during their previous stay, including if they have outstanding payments.

6.6. Checking the technical condition of the apartment before check-out:
Before check-out, Villa Coaster reserves the right to check the technical condition of the Apartment. If damage is found to have occurred during the Client’s stay, the Client is obliged to cover the cost of repair in full, no later than the day of check-out.

6.7. Early departure:
Early departure due to reasons beyond the control of Villa Coaster does not entitle to claim a refund for unused services.

7§ – Responsibilities of the customer during the stay in the apartment

7.1. Purpose of Apartment Use:
The customer agrees to use the apartment for tourist or leisure purposes only, and may not sublet or give the apartment for free use to any third party.

7.2. Reporting irregularities:
Immediately after check-in, the Client should report any irregularities found in the Apartment, otherwise this may result in the Client being charged for the cost of repairing the damage found.

7.3. Silence at night:
The apartment has a curfew from 10:00 pm to 6:00 am. Violation of generally accepted norms of social coexistence and disturbance of neighbors may result in immediate termination of the Reservation by Villa Coaster, without refund for unused time of stay.

7.4. Prohibition of events:
It is forbidden to hold any kind of party in the Apartments. Violation of this prohibition may result in immediate termination of the Reservation by the Lessor, without refund for the unused time of stay.

7.5. No smoking:
Smoking, stimulants and e-cigarettes are strictly prohibited in the apartment. Failure to comply with this prohibition may result in an additional fee of PLN 500, while retaining Villa Coaster’s right to claim compensation on general terms.

7.6. Security of the Apartment:
Customers are required to properly secure the Apartment, lock the front door and windows when leaving, and carefully store the keys. Taking things out of the Apartment is prohibited.

7.7. Maintaining the condition of the Apartment:
The Client is responsible for maintaining the Apartment beyond normal wear and tear. On the day of check-out, Guests are required to dispose of garbage in the containers outside the building.

7.8. Right of Access to the Apartment:
Villa Coaster or a designee shall have the right to enter the Apartment in order to rectify a malfunction or in the event of a reasonable suspicion of a violation of the Terms and Conditions by the Client.

7.9. Operation of faucets, fixtures and electrical equipment:
The customer is responsible for the proper operation of faucets, fixtures and electrical appliances. Due to fire regulations, customers are not allowed to use electrical appliances that are not equipment, except for a computer, razor, hair dryer and phone charger.

7.10. Liability for items left in the Apartment:
Villa Coaster is not responsible for items left in the Apartment. Any return of found items is possible only at the expense of the customer.

7.11. Responsibility for guests:
The Client is responsible for the acts and omissions of all guests staying with him in the Apartment as if they were his own.

8§ – Additional Services:

8.1. The customer has the opportunity to order additional services according to the price list below:

  • Pet stay – 50 PLN/day/pet, available only in selected Apartments and by prior arrangement,
  • linen and towel replacement service – price determined individually depending on the number of guests. The date and time of the service must be agreed no later than one day in advance and confirmed by Villa Coaster,
  • Apartment cleaning service – 200 PLN, one-time service.

8.2. Additional services are provided upon receipt of payment confirmation to the Villa Coaster Grzegorz Urbańczyk account: 10 1050 1302 1000 0097 8236 7842.

9§ – Residence of pets:

9.1. Only in selected apartments there is the possibility of pets. The staff of the apartment has the right to refuse to provide it to customers who have brought a pet without prior arrangement.

9.2. It is required a booklet confirming current vaccinations of animals. A kennel bed/cage, etc. should be taken for all pets. Pets are not allowed on couches, sofas, armchairs, etc.

9.3. An additional fee is charged for the stay of pets, according to the price list of Additional Services and payable before arrival to the account of Villa Coaster Grzegorz Urbańczyk: 10 1050 1302 1000 0097 8236 7842. For more than one pet, Villa Coaster reserves the right to charge an additional deposit of PLN 1000.

9.4. The owner is obliged to clean up after his pet.

9.5. The client is fully responsible for the stay of the animal and any damage done by it, including, in particular, cleaning carpets, armchairs, sofas from hair or removing odor.

9.6. If, on the day of check-out, the condition of the Apartment makes it impossible for any further persons to stay, a fine of twice the price per night of the Apartment will be imposed on the Client.

10§ – Liability:

10.1. Villa Coaster is not responsible for inconveniences, caused during your stay, related to:

  • interruption of the supply of utilities for reasons beyond the control of Villa Coaster,
  • Noise from neighboring properties.

10.2. Villa Coaster is not responsible for loss or damage to the vehicle left by the Client in the outdoor parking spaces.

10.3. The customer shall be responsible for any damage caused by his/her actions resulting from the use of paid or unpaid attractions that are located on the premises where the customer rents the apartment.

10.4. The customer is obliged to immediately report any damage caused by him during his stay and immediately pay for its equivalent. The Client is also fully responsible for damages caused by persons staying in the Apartment with their consent or knowledge. If the damage prevents further rental, the Client is additionally financially liable for each day excluded from rental, in the amount of twice the current price for the Apartment.

10.5. If the apartment is contaminated with vomit, the Client is obliged, at the request of Villa Coaster, to cover the cost of cleaning carpets and other contaminated materials – in the amount of PLN 1500.

10.6. Smoking cigarettes, other tobacco products, stimulants in the Apartments and in the stairwells, as well as the use of candles is prohibited. Violation of the ban, entitles Villa Coaster to impose a contractual penalty of PLN 500.

10.7. In the event of failure to return the Apartment at the end of the reservation, the Client shall be obliged to pay twice the current price for the Apartment, as specified on www.villacoaster.pl, for each day after the date of termination of the reservation.

10.8. At check-out, the Client is required to return all provided keys or entry cards and remote controls. In case of non-return, the customer is charged 500 PLN (keys, key card) and 500 PLN (remote control) respectively.

10.9. The apartment cannot accommodate more people than the number specified at the time of booking. If the number of people is higher, the client will be charged an additional fee of PLN 200 for each additional person for each night.

10.10. If the damage exceeds the value of the penalty or surcharge reserved in these Regulations, Villa Coaster shall be entitled to claim compensation on general terms.

10.11. In case of unjustified call of Villa Coaster employee to the rented apartment, an additional fee of 300PLN will be charged, which will be collected by an authorized Villa Coaster employee on the day of arrival.

12§ – Final provisions

12.1. The law applicable to disputes between Villa Coaster and the Customer is Polish law.

12.2. Any disputes will be resolved by the court having jurisdiction over the registered office of Villa Coaster.
